Cl d felony theft in IN. What to put on a job application if it's to be reduced after probation is over?
I worked as a manager at a store in the mall. A few days after I get back from my week vacation I get a call from the DM about missing bank deposits starting from the 1st of the previous month. She comes to the store and starts talking to me and the istant (who I believe is the guilty person). She then tells me that Mike from LP is on the phone (her cell phone) and he wants to talk to me. At this point the istant has since left early to go to her other job, but kept talking about how she should just quit. I start talking to Mike and he tells me "what would you say if I told you we could get proof of who did it" I say, 'good, you do that" he then asks me "are you sure that you didn't do this or don't know who did it? are you covering up for someone?" i say "no, are you trying to put this on me? because i didn't do it!" he keeps pissing me off to the point I started to cry. he then asks "are you crying because you know you made a mistake? everyone makes mistakes, and im sure that if you tell corporate that you took them to help out, say, a family member who needed the money, they would be understanding. let me help you out." again i say "no, i didn't do this or know who did" I then ask him if I was going to get fired for not noticing that they were missing and he tells me that I could trust him to do everything he could to help me keep my job, but they had to have someone be responsible. My daughter was 2 at the time, I was in the middle of a divorce, and could not afford to lose my job so I told him I would say I took 3 (of the 15 missing) so that way I could keep my job and also figured that if I didn't say I took all of them that they would have no choice but to look further into the matter. He then told me that if I wrote a letter of apology to my DM that it would show corp. that I was trying to fix the problem. He then instructed me on what to write, that I had taken them to help my mom with bills, that I was really sorry, which deposits I had taken, and the total amount of them. Now being a watcher of The Wire I should have realized what was going on, but all I could think about was how much I needed to keep my job, so I was dumb enough to actually start writing. I did however purposely write down a date that wasn't actually missing, which when the DM read it, she noticed and made me change it to a date that was missing $800!! (you can see where she had me change it, since I chose to write in pen for just such an occasion) And she keeps telling me that Mike is a good guy, and I can trust him to do what he says he will do. Next thing I know, two cops show up at my store. I ask her why she lied to me and she says "I guess he didn't believe you" I was walked out of the mall (not detained), went to put my purse in my car and was allowed to call my mom to have her come pick it up for me. Then walked to the cruiser where I was handcuffed and read my rights. The cop pulls out a recorder and tells me "you understand that you are being arrested for theft in the amount of $1,191 from ****" I say, "that's what they are claiming" (I am now pissed because I know they screwed me, KNOWING I only agreed to all this because of my desire to keep my job for my daughter) I go through booking, then can't seem to get ahold of anyone from the phone in the holding cell, so when I am let out so they can take my mug shots I realize that one of the officers there is also one of the security guards from the mall that I had made friends with over the 3 years I worked for this company. THANK GOD! He allowed me to use their phone to call my mom and tell her my pin number on my bank card to get the money to bond me out. (Just so happened to be payday, or else my *** woulda been sitting in there!) I sit in jail for about 2 hours, and get released. Now jobless, I don't know what to do about getting a lawyer, but I know I need one. And a PD was not really an option, cuz they aren't worth a damn. Boyfriend tells me about the lawyer his child's mom used and was able to get her off pretty good, so I go talk to him. He agrees to take the case. The only thing they actually have against me is this damn "letter of apology". He tells me I am basically screwed, that I should have never written this (no duh) but he would do the best he could. He does all the formalities. Was originally charged with 3 counts of felony theft (more proof all they had was the letter, because if they really knew if I was guilty, it would have been 15) he comes to me with a plea agreement, and also explains, I have the right to go to trial (more money I didn't have) and that if I decide to do that, I would go up against all three charges and with the letter would most likely lose.
